Update of the complaints handling manual of Human Right National Commission à Djibouti
General information
a.Brief information on the project
The objective of the Better Migration Management II (BMM II) Programme is to improve the human-rights based management of safe, orderly and regular migration and to support competent/national authorities addressing the trafficking in human beings and the smuggling of migrants within and from the Horn of Africa.
The BMM II program has three components:
•Migration Governance;
•Cooperation on Anti-Trafficking and Anti-Smuggling;
•Protection.
The Programme is commissioned by the German Federal Ministry for Economic Cooperation and Development (BMZ) and co-financed by the European Commission. It is envisaged to be implemented from October 2019 – September 2022. The implementation is facilitated through an Implementing Partnership consisting of IOM, UNODC, CIVIPOL, British Council, and the lead agency GIZ. The Programme’s interventions target countries are in the Horn of Africa region, i.e. Djibouti, Eritrea, Ethiopia, Kenya, Somalia, South Sudan, Sudan, and Uganda.
As part of part of the implementation of BMM programme, GIZ has a dual role of both coordinating the activities of the implementing partners based on the agree-upon annual work plan, as well to implement activities.
GIZ,after consulting its national stakeholders and partners during the annual planning, determined that to achieve its objectives continuing to operationalize the CNDH Djibouti complaints mechanism concerning human rights violatsions is key. In fact, at the end of the first phase, accompagnied by BMM the CNDH Dj elaborated a complaint necanism for human rights violation, including a form to fill in at anytime a case is suspected. With this first experience background and to be able to more and better take the specific needs of the most vulnerables, the CNDH feel the need to update its tool.
b.Context
Under strategic objective 2, which is focused on the effectiveness of institutions to address trafficking and smuggling of migrants, one of the outputs GIZ-BMM aims to acheive is to increase the number of monitored, reported and followed-up cases of human rights violations against migrants, with a focus on women, boys and girls. To this end, BMM II envisages to engage a consultant to update the form used by the CNDH Djibouti to register violations of human rights within its complaints mecanism.To achieve this, an breaf assessment of the tools of the existing other procedures will be undertaken to double check the data needed to inform the national human right commission. These data will then provide the CNDH with the most adequate framework for gathering data to identify, monitor and report on human rights violations against VoTS and migrants while, taking cognizance of the data protection regulations in the Rep. of Djibouti; and , it will enhance and strengthen cooperation and coordination among the National Human Rights Insitution (NHRI) and its main partners. With respect to the CNDH mandate, the complaint form update will contribute to (i) placing specific attention to migrants in vulnerable situations, including women, children, and undocumented migrants at a national level to ensure that their human rights violated are taking into account, (ii) provide update to adequate instrument to actors involved in human rights protection through the CNDH.
c.GIZ shall hire the contractor for the anticipated contract term, from 12.07.2021-31.08.2021.
d.To achieve this, the following specific objectives listed below shall guide the contractor to undertake the assignment :
Specific Objectives
1. To breafly assess the tools of the other existing procedures and document them regarding identifying, proceeding and reporting human right violations cases;
2.To capture the specific data needs for CNDH Dj for migrant’s human rights violations cases;
3.To update the complaint form from the mechanism put in place by the CNDH.
The consultant will undertake the following tasks
1.Familiarize with BMM programme and the context in which it is implemented;
2.Familiarize with the CNDH as an organization in general and with it human rights complain mechanism system;
3.Undertake a comprehensive desk review of relevant documents (laws, policies, guidelines, regulations etc.) to establish the overall national context regarding migrant and human rights;
4.Assess in a gender sensitive way the existing other procedures developed or any relevant adhoc systems used in the country;
5.Update the complaint form, taking into account the cases of the most vulnerable ones such as the Women and Girls and Boys;
6.Facilitate a meetimg with the CNDH staff to present them the updated form.
Deliverables/Outputs
Present a report to BMM Djibouti office detailing the following:
1.An outline of the methodological approach to be used in executing the assignment;
2.A harmonized form regarding the identification, processing and reporting human rights violations;
3.Approved BMM design submitted to GIZ-BMM for feedback.
Risk Assessment Guidelines
1.The consultant should adhere to the Data Protection and Privacy law/policy in the Rep. of Djibouti in utilizing data collected.
2.The consultant adheres to GIZ’s intellectual property rights to materials and information produced in accordance to GIZ’s operational data protection regulations.
3.Adhere to the BMM communication and visibility concept.
Reporting
The consultant will report in French to the BMM Djibouti office. All reports should be provided according to BMM report layout .

Education: for example, university qualification (first degree/master’s) in Law, Human Rights Studies, Migration Studies, Social Sciences, International Relations/Affairs or related field.
Professional experience: open to young professionals
1.1.2 Experience in the region/knowledge of the country: Djiboutian National encouraged to apply.
1.1.3 Language skills: business fluency in French. A good command of English would be considered as an asset and knowledge in local languages recommended.
2. Appropriateness of proposed concept
Please specify between one and five objective criteria which are to be used for an objective evaluation of the concept within the ‘Assessment grid for the technical evaluation of tenders’ and enter these in the second section of the grid. (2.1 – 2.5.)

5 Fixed lump sum price – contract for work
Since the contract to be concluded is a contract for work, we would ask you to offer your services at a fixed lump sum price, which covers all relevant costs (fees, travel costs, etc.). The assessment of the financial bid is based on the lump sum price tendered. For the purposes of our internal calculations and any subsequent contracts, we would also ask you to state the daily rate used for the tender. A breakdown of the days is not necessary.
